This poll was conducted prior to Kelty's October 22nd legal filing to dismiss all charges against him. A lawyer friend of mine has stated to me that this filing is very compelling and that it is quite possible that all charges will be dropped without going to trial. This is the full text:

My letter to the editor regarding the Kelty birthday cake appeared on 10/17 in the Journal-Gazette and the wonderful Frank Gray article regarding my love, Apryl, appeared the following Sunday, 10/21.

These are my points:
1. This is an "old" poll because of the events stated above. It was conducted at the worst of moments, immediately following Congressman Souder's statement, before the end of the Kelty birthday cake issue and before Matt's motion to dismiss all charges. Lots of people were waiting until after the debates before deciding which candidate would receive their vote. The bulk of these are not waiting for our political opponent. They are waiting for Matt Kelty!
2. Kelty is surging right now because of the debate. Since the debate we are receiving hundreds of calls of support. We have run out of yard signs. The last sign out the door did not have the wire needed to put it in the ground. The individual who took that sign also took some wooden stakes and was very determined to place that sign in his yard. That individual is a life-long Democrat.
3. Of course our political opponent will use results from an older poll to try to stop the Kelty surge. They have to do something because they may lose the only poll that really counts - Nov 6th.
4. The old poll tactic will not work because the voters are pretty smart. Our political opponent is advocating more debt and more taxes. Why would the voters decide for the absolute certainty of more debt and taxes? Many of them won't because it is their money. They will decide FOR the certainty of holding taxes steady and possibly even reducing them over time. They will vote for paying off the debt. The indictments look really suspicious. Their timing couldn't be worse for fundraising and building confidence in our candidate. If it wasn't for the indictments this really would not be a contest.
5. The issues transcend politics and personalities. Our political opponent is weak on the issues. He would be a caretaker of the current city government. On 10/22 Matt Kelty dealt with the Grand Jury indictments and he will be vindicated by the courts. Matt Kelty is indeed innocent. He will take city government in a different direction.
6. The people of Fort Wayne want a voice in local government. This election is about giving the people a voice. That voice IS Matt Kelty. Many people who are stopping in at Kelty/GOP HQ on Harrison and Main are indeed Democrats. Why? Because, as these supporters tell it, Matt Kelty is someone who has been beaten down by the system just like they have. The person of Matt Kelty is real. He transcends political parties. He is their chance to escape from a system of poverty and government abuse. He is indeed one of their own and one of our own.
Be encouraged! This race can be won! Will it be won? You are a key!

When he concludes by saying "In His Service" is he talking about God or Kelty? Or is there no distinction?

They probably see no difference in Kelty and God.

if kelty's civil rights are being violated, and if what is happening to him is illegal, then why arent his high priced lawyers, and the (gasp!) ACLU filing criminal charges against the system?
If he is so innocent, and the motion to dismiss is so ironclad, then why arent prominent GOPhers flocking to his side?

Damn, Roach is starting to make sense. This case should be venued out of Allen County- there has been too much publicity. Of course, Kelty's blunders are known all over the state of Indiana so I'm not sure there is a jury available within the state that isn't already aware of what is going on.

I do not believe the ACLU gets in on the actual trials of criminal charges. They have weighed in on appeals of guilty verdicts.
I am not sure how you have gotten civil rights into this? Civil right issues are generally taken to federal court and not state courts.
Some issues his lawyers have raised are "boiler plate" issues so they can be revisited in the appeal process, if needed. If they do not raise these issues now, they can not later ask the courts to consider them in the appeal process.
My belief has been from the start that Kelty would not be found guilty because of of some of the reasons his lawyers have raised. I also believe that a jury of his peers, if need be, will find him not guilty because the lack of intent.
But instead of finding him guilty like you have, I will support his right to a fair and open trial.
My guess if the Judge does not agree with Kelty's laywers to dismiss all charges, that she will remove herself as judge. I do not think Kelty's lawyers will need to ask for such.
As for moving the trial out of Allen County. Gosh, I think that may be a stretch but it could happen.
Heck, look at the number of murder trials we have in Allen County each year, with most juries composed of local residents. Often these juries are selected within four to six hours.
Mr. Roach, you know more better then most about what it is like to run for politicial office within Allen County. You found regardless of your platform, beliefs, and so forth you where shut out. The powers of the two parties would not let you have a place at the table.
The only reason Kelty was not shut out by the GOP was there was some pople, who had the financial worth to support him. Without that financial support, he would have ended up like your runs for office.
